The following terms and conditions (collectively known herein as "Terms of Service") govern your ("user" and/or "member") access to and use of www.realdesperation.com or realdesperation.com ("we", "us", "our", "site", and/or "Real Desperation"), including all content, functionality, and services offered on or through the site. By accessing and using this site, you certify that you have read and agree to the Terms of Service, as well as our Privacy Policy. If you do not agree to the Terms of Service and the Privacy Policy, you must cease access and/or use of this site immediately. If you do not understand the Terms of Service, or you do not know the legal restrictions in regards to any and all media available for consumption and distribution on this site, you should consult an attorney or legal advisor before agreeing to the Terms of Service.

Real Desperation contains media ("material" and/or "content") which is sexually explicit in nature and intended for individuals who have reached the age for which it is legal to consume and distribute such media within the individual's specific jurisdiction, which is most commonly 18 or 21 years of age.

Real Desperation contains embedded media from third party websites and online services. While we take due care in ensuring the content which appears on our site meets the expectations of our users, we cannot be held responsible for the contents of media embedded from third party services (e.g. advertisements).

Real Desperation does not produce, nor condone the production of, media which is both: sexually explicit in nature, and produced without the consent of the participant(s) involved, within a jurisdiction where the production of such media is considered illegal. A liability for any claims emerging from media accessed via Real Desperation for which the production, consumption or distribution is considered illegal within a jurisdiction outside of the United Kingdom of Great Britain and Northern Ireland is explicitly ruled out.

Real Desperation allows users to upload, host and share sexually explicit media on our site. If a user chooses to do so, it is the user's responsibility to ensure the legal compliance of the media which they submit.

By uploading media to our site, the user grants us the non-exclusive license to use, distribute, and modify the media as we see fit.

By accepting the Terms of Service, you certify the following:

1. You understand and acknowledge all of the aforementioned provisions.
2. You are at least 18 years of age and legally recognised as an adult in the jurisdiction in which you reside.
3. The consumption and distribution of sexually explicit material is not illegal in the jurisdiction in which you reside.
4. You are not offended by media which is sexually explicit, and you desire to consume such media.
5. All media provided by Real Desperation which you consume and distribute is for your own personal use, and you will never expose said media to anyone who is not legally able to consume or distribute it, such as a minor.
6. You will not attempt to gain access to media, information or content beyond what is intended by Real Desperation for you to access, consume or distribute, or attempt to circumvent any security measures present on Real Desperation.

This Terms of Service constitutes a legal agreement between Real Desperation and yourself. You agree that by continuing to use this site and its services, you are subjecting yourself to the jurisdiction of the United Kingdom of Great Britain and Northern Ireland should any dispute arise at any time between Real Desperation and yourself.
